GENERAL CONDITIONS OF TENANCY

1) Tenancy
Rental is settled directly with MURACCE SAS di D'Angiolo Giuliana & C., at the prices indicated on the web site of GIARDINO DEI SEGRETI - Strettoia di Pietrasanta (Lucca).

2) How and where to book
The holidaymaker can book via MURACCE SAS.

3) Payment - Tenancy Voucher
On receiving confirmation, the holidaymaker should pay MURACCE SAS a deposit of 30% of the full price. Payment of the balance must take place at least 30 days prior to the beginning of the tenancy, upon the receipt of which, the holidaymaker will be sent a Tenancy Voucher. For bookings made less than 30 days prior to the beginning of tenancy, the full amount has to be paid immediately.

4) Minimum Rental Period - Prices
The minimum period of tenancy is one week, from Saturday to Saturday. Tenancy prices are on a per house/apartment/per week basis, and are differentiated according to season, as listed on the website.

5) Time of Arrival and Departure
Unless otherwise specified in the description of the lodging, arrival and departure times are as follows. Arrival; Saturday between 5.00 and 8.00 pm. Departure; Saturday between 8.00 and 10.00 am. Any variation regarding the date and time of arrival must be communicated to MURACCE SAS, and must be approved at least 3 days beforehand. In the case of an unexpected delay on the Saturday of arrival, the holidaymaker should telephone MURACCE SAS between 4.00 and 8.00 pm.

6) Upon Arrival
On arriving at the house/apartment, the holidaymaker must present the tenancy voucher and a valid passport or identity card, so that his presence can be registered in accordance with the law.

7) Cautionary Deposit
The holidaymaker must provide the owner a cautionary deposit, at the moment in which he receives his keys. This must be in cash, in EUROS, as indicated on the website. The deposit will be returned upon departure, subject to the deduction of expenses for any damage to the apartment or any supplementary expenses not included in the tenancy price.

8) Number of Guests - Substitution of Guests - Pets
Only the guests whose presence has been registered with the competent authorities can stay in the accommodation. Their total number (adults and children) cannot be superior to the number of beds indicated on the website, with the exception of children under the age of 2. Other exceptions are listed on the website. Any substitution of guests during the period of tenancy is forbidden, unless previously agreed with MURACCE SAS. The holidaymaker must inform MURACCE SAS, at the moment of booking, of any eventual pets, indicating their number and size. It is the responsibility of the holidaymaker to supervise pets while they are being taken through the common spaces inside the property.

9) Tidiness - Cleaning - Heating
Houses/Apartments are consigned in a completely clean and tidy condition.

10) External Maintenance
If necessary, the owner reserve the right of access to carry out indispensable maintenance work (gardens, swimming pool etc.).

 

 

 
11) Modifications - Cancellations
The cancellation of a booking envisages the payment of the following penalties: up to 30 days prior to the beginning of the tenancy, 50% of the total price of the booking; subsequently, 100% of the total price of the booking / AS WELL AS ANY EXTRA EXPENSES INCURRED.

12) Responsibilty
Descriptions reproduced on the website are accurate and supplied in good faith.

13) Legal Competence
For any dispute regarding the booking and tenancy, the Law Court of Lucca has legal jurisdiction. Italian Legislation is applicable. Booking implies knowledge of the General Conditions of Tenancy of GIARDINO DEI SEGRETI, and leads to their acceptance without reservation or exception. If one or more of the conditions of this contract were or become invalid, or if an omission should come to light in this contract, the validity of the remaining conditions cannot come under question.

14) Protection of Personal Details
In accordance with the provisions of Law 675/96 for the Protection of Privacy and the Treatment of Personal Details, MURACCE SAS, with its head office in Strettoia di Pietrasanta (Lu), wishes to inform you that your personal details will be kept and used solely for purposes directly connected with our activities; i.e.:

a)Purposes
a.1)The stipulation of contracts of tenancy, through the procedures of booking; execution and correct fulfilment of pertinent contractual obligations; management and resolution of judicial and jurisdictional disputes;
a.2)The provision of information promoting our tourist programmes; despatch of catalogues; survey of level of satisfaction of MURACCE SAS customers.

b) Utilisation
The conferment of personal data is necessary for the fulfilment of contractual, administrative and fiscal obligations as envisaged by legislation.

c) Consequences
Failure to consent to the utilisation of data for the purposes outlined above in Point a.1 would have the consequence of making it impossible on the part of MURACCE SAS to fulfil its contractual obligations.
As far as Point a.2) is concerned, a refusal to utilise data does not have any effect.

d) Methods
Personal details will be processed with the help of modern computer systems, and handled by staff employed specifically for this purpose. Your details will not be communicated and/or made available to third parties, unless necessary according to legal or contractual obligations.

e) Rights
You have the possibility of exercising your rights, as laid out in Article 13 of Law 675/96, by communicating with the Head of Personal Data D'Angiolo Giuliana.
